DAZN Coins & Virtual Items Terms for Japan

1. How to obtain Coins

1. Coins will be granted to you through purchases on the Platform, campaigns, by carrying out certain actions and other methods designated by DAZN. The purchase unit of Coins, payment method, and other conditions for granting Coins shall be determined by DAZN and displayed on the Platform or DAZN's website.
2. Whether any currency exchange fees, foreign transaction fees and any other settlement fees are charged is based on the contract between you and your payment provider.
3. Coins and Virtual Items do not constitute property and may not be transferred (i) upon death, (ii) as part of a family matters, or (iii) by application of any other law.

 

2. Obtaining Coins by certain actions

1. When you perform the action of paying money or other consideration to receive a specific service/goods and obtain Coins, such payment will be made for the purpose of receiving such service/goods and not for the purpose of obtaining Coins.
2. The specific details of the action, the number of Coins granted, and other terms and conditions related to the Coins are determined individually by DAZN, the business partner or the advertiser (the business partner and the advertiser collectively referred to as the "Coin Affiliate"). When acquiring Coins, you shall check the terms and conditions of how Coins are granted before performing any action.
3. In the event that an action is canceled, fails to meet the conditions for granting Coins, or if DAZN or a Coin Affiliate determines that the method of performing the action constitutes fraudulent or other inappropriate act (including the case of obtaining Coins by reselling or purchasing cash vouchers, stamps, tickets, etc. for commercial purposes), DAZN can take necessary measures such as not to granting the Coins or cancelling the Coins that have been granted ("Granted Coins"), etc.
4. In the event that DAZN takes the necessary measures set forth in the preceding paragraph, if Granted Coins have already been consumed, DAZN may follow procedures to, revoke the same number of Coins other than the Granted Coins held by you instead of cancelling the Granted Coins. In addition, in the event that DAZN requires you to make payment to DAZN in cash or by a payment method designated by DAZN as a necessary measure, you shall immediately pay DAZN such payment.

 

3. How to use Coins, etc.

1. When using Coins and Virtual Items, please follow the procedures specified on the website. In addition, Virtual Items obtained by exchanging Coins may be subject to additional terms and conditions.
2. Coins and Virtual Items may not be exchanged for cash, any type of currency, or any other form of credit.
3. Detailed conditions such as the scope of eligible Virtual Items, the number of Coins required to obtain Virtual Items, the amount of Virtual Items granted, the validity period and terms of use, and the time required to exchange Coins for Virtual Items vary from Virtual Item to Virtual Item and may be determined and changed at DAZN’s discretion.
4. Coins are valid for 180 days from the date of acquisition (the date of acquisition shall be counted as the first day). You will not be able to reinstate expired coins for any reason.
5. Notwithstanding the preceding paragraph, if you are granted Coins with a fixed expiration date of less than 180 days from the date of acquisition (hereinafter referred to as "Limited-time Coins"), you must use the Coins within the expiration date set by DAZN. Limited-time Coins expire after their expiration date and cannot be exchanged or used. Also, you will not be able to reinstate expired Limited-time Coins for any reason.
6. The equipment required for using Coins and Virtual Items shall be prepared by you. In addition, you shall be responsible for any taxes and incidental costs incurred in connection with the acquisition of Coins, the use of Coins, and the acquisition and use of Virtual Items.

 

4. Terms of Use

1. DAZN grants you permission to use the Coins and Virtual Items on the condition that you do not do any of the following:
2. Acts that may lead to crimes such as fraud.
3. The act of aggregating Coins belonging to multiple DAZN accounts into a single DAZN account.
4. Acts of entering false information for obtaining Coins and Virtual Items.
5. Acts of exchanging coins for cash, property, or other economic benefits by a method other than the method designated by DAZN.
6. Acts of illegally collecting, disclosing, or providing personal information, registration information, usage history information, etc. of others.
7. Acts of use beyond the scope of normal use, such as repeating the same or similar acts.
8. Acts that support or encourage any of the above acts.
9. Other acts that DAZN or a Coin Affiliate deems inappropriate.
10. In the event that your DAZN Account is suspended due to any fraudulent activity, including the acts set forth in the preceding paragraph, you will be restricted from obtaining and using Coins and Virtual Items through your DAZN Account. In this case, DAZN shall not be liable for any damages caused to you.
11. Any rights regarding the Coins must not be lent or provided as collateral.

 

5. Your Responsibilities

1. If DAZN determines that you have acquired or used Coins and Virtual Items in violation of these Terms, DAZN may suspend the use of the Coins and Virtual Items or take other measures that DAZN deems necessary and appropriate against you. Provided, however, that DAZN shall not be obligated to prevent or correct such violations.
2. In the event that DAZN suffers damage due to your willful misconduct or negligence, you must immediately compensate DAZN for the damage in accordance with DAZN's request.

 

6. Non-Warranty

DAZN shall not be liable for any defects related to the service related to Coins and Virtual Items (including defects related to security, errors and bugs, infringement of rights, etc.) and does not warrant the safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose, either explicitly or impliedly. DAZN shall not be obligated to remove such defects and provide the Coins and Virtual Items.

 

7. Our Disclaimer

DAZN shall not be liable for any damages or other disadvantages (this includes damages arising out of or in connection with the use of content, advertisements, products, services, etc., or the acquisition, use, or inability to use Virtual Items of the Coin Affiliates, as well as damages arising from the unauthorized use of Coins held by you by a third party. ) incurred by you as a result of such action, except in cases caused by DAZN 's willful misconduct or gross negligence. DAZN shall not be liable to compensate for damages caused by lost profits or other special circumstances, and shall be liable for damages within the scope of direct damages that could normally arise.

 

8. Severability

If a provision of these Conditions is determined to be unlawful and/or unenforceable, the validity of the rest of the Conditions shall remain unaffected. If any unlawful or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

 

9. Changes to these Terms

We can modify these Conditions at any time if we deem the changes suitable to your general interest, or reasonable, without defeating the purpose of these Conditions, in light of the necessity for and relevance of the changes and the circumstances in relation thereto. We will notify you about changes to these Conditions by posting the changes on our website. In addition, if the changes to these Conditions are material (for example, where we change our payment terms for Paid Subscriptions or require you to obtain additional technology) we will notify you by sending an email notice to the most recent email address we have on file for you. In the event that we fail to notify you about changes because the information you have registered is false or not up-to-date, or due to any other reason resulting from you, such notice shall be deemed to have arrived at the time it would normally have arrived. We shall not be liable to you for any damage or loss incurred by you due to circumstances on your side. You will be deemed to have accepted these modified Conditions, unless you object to the changes within thirty (30) days from that notification, provided that we will make you aware of this consequence of a lack of objection in the notification.

 

10. Elimination of antisocial forces

1.   You represent and warrant that neither you nor any of your representatives, officers, persons with substantial management authority, employees, agents or intermediaries (hereinafter referred to as "Related Persons") do not currently fall under any of the following categories: organized crime groups, organized crime group members, quasi-organized crime group members, organized crime group-related companies, socially motivated crime groups, political motivated crime groups, special intelligence crime groups, or persons closely associated with these persons or persons similar thereto (hereinafter referred to as "Anti-Social Forces"), and shall not fall under any of the above in the future.

6. Acts that disseminate rumors, use fraudulent means or use force to damage the credibility of DAZN, or interfere with DAZN's business.

Other acts equivalent to the preceding items.

1. If it is found that you have violated any of the representations or commitments set forth in the preceding two paragraphs, DAZN may terminate this agreement and discontinue the provision of the Coins without any notice. Even if you incur any damage due to such cancellation, DAZN shall not be liable to you in any way.

 

11. Governing Law and Jurisdiction

The official text of this agreement shall be Japanese, and the governing law shall be the laws of Japan. Any dispute arising out of or in connection with the Coin and Virtual Items between you and DAZN shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
