1. About us
1.1. Hello and welcome to the world of DAZN. We are a service that offers its users streaming access to a wide range of sporting events from around the world on a variety of internet-enabled devices, including TVs, PCs and other platforms either free of charge ("DAZN Service") or for a fee through membership in specific Pricing Plans ("DAZN Plan(s)"), also jointly referred to as "DAZN Services"). In order to improve the use of the DAZN Services by the User, suggestions regarding events in which the User may be interested and other information will also be provided.
1.2. The DAZN Services are provided by DAZN Limited ("We", "DAZN"). DAZN Limited is a company of the DAZN Group, incorporated and governed by English law, with its registered office at 12 Hammersmith Grove, London, W6 7AP, United Kingdom and a branch office at 16 Piazza della Repubblica, 20124 Milan, Italy. We are solely responsible for the provision of the DAZN Services and the application thereof without prejudice to any responsibilities of third parties who, on the basis of agreements with DAZN, directly provide certain services other than the DAZN Services (for example, payment services).
1.3. DAZN guarantees the rights of users to adequate and transparent information as expressly provided for in the Service Charter, which is to be understood as fully referred to in these terms and conditions of use.
2. Main Conditions of Use
2.1. We provide online video streaming of sporting events (both live and on demand), news about sporting events and other related content, the composition and availability of which may vary over time (collectively, the "Content"). The Content is usually subject to certain limitations (including, without limitation, certain territorial limitations).
2.2. Users who have subscribed to a DAZN Plan in Italy, indicating a valid and recurring payment method such as, among others, credit card, PayPal, Apple Pay or Google Pay, linked to their account, shall enjoy the same Contents of the said DAZN Plan even when they are temporarily in other countries within the European Economic Area (EEA). In order to check whether the DAZN Plan subscribed to includes EU portability (EU Regulation 2017/1128), the user must check the details of the DAZN Plan chosen in the "My Account" section https://www.dazn.com/en-IT/myaccount/subscription".
2.3. Before activating the DAZN Services, you are encouraged to read these Terms Contractual Terms of Use ("Terms"). Please note that any offer, promotion or discount you may receive may be subject to additional terms and conditions that supersede or supplement these Terms. In the event of any conflict between these Terms and the additional terms, the latter shall prevail.
2.4. We may make changes to these Terms, such as, but not limited to, in the event of changes, in order to ensure better functionality, in the event of technical and/or economic requirements, changes in commercial policies and/or technical changes to the platform, changes in market conditions and/or the need to address security requirements or issues, including in relation to abusive and/or fraudulent phenomena that have occurred. Any changes to these Terms will be notified to you by e-mail to the most recent address in our possession. Any changes to the payment terms will also be notified to you in the same manner. You may terminate your contract without penalty within sixty (60) days of such notice if you do not wish to accept the changes in accordance with Section 4.7 of these Terms. In the absence of such notice of termination within the aforementioned period, the contractual changes shall be deemed accepted. Notwithstanding the above, changes made in order to comply with the law, regulatory changes or to adapt to indications from public institutions or authorities or to adapt the offer on the basis of changes resulting from changes in agreements with the owners of sports rights and, finally, changes that are exclusively for the betterment of the user in the use of the service, may take effect immediately and the aforementioned information notice will not be necessary.
2.5. The DAZN Services and all Content displayed through the same are for your personal and non-commercial use only. By activating the DAZN Services, you are granted a limited, non-exclusive and non-transferable licence to access and view Content on an exclusive streaming basis. With the exception of such limited licence, no other rights, interests or title shall pass to you. You agree not to use DAZN Services to enable viewing by the public.
2.6. Subscription to one of the DAZN Plans is subject to the authorisation, by the respective payment service provider supported, of all payments due from time to time or the validity of the user's promotional code, if any. Please note that payments will be handled by a payment service provider located within the European Union.
2.7. You agree that DAZN may share information with third party rights holders in relation to the Content displayed by you while using the DAZN Services. Such information will be shared on an anonymous basis.
2.8. We may terminate the existing contract with you at any time by means of written notice by e-mail at least sixty (60) days prior to the end of the current DAZN Plan. This is without prejudice to the right to terminate for just cause pursuant to Article 7.2 below. In the event of termination of the contract in force with the user for reasons other than breach of contract by the user, the user may be entitled to receive a refund of the sums paid as consideration for the services relating to the DAZN Plan chosen and not yet used.
3. Duration
3.1. Without prejudice to the provisions of Article 7 (Withdrawal), in the event of adhesion to one of the annual DAZN Plans, the duration of the Plan itself is 1 (one) year from its activation, with tacit renewal from year to year unless withdrawal which may be communicated in accordance with the procedures set out in Article 7 below.
3.2. In the case of the activation of the DAZN Monthly Plan, the contract shall run for one month from the date of activation and shall be renewed every month unless terminated in accordance with the procedures set out in article 7 below.
3.3. It will be possible to know the renewal date of your DAZN Plan by accessing your personal "My Account" area of the DAZN website and, for the annual DAZN Plan, DAZN shall inform the user of the approaching expiry date at least 30 days in advance.
4. Free trial period and free content
4.1. If the user takes advantage of an offer with a free trial period of the DAZN Plan, this free trial period will be specified during the relevant subscription procedure and, during this period, the user may receive, in the event of the communication of the required consents, offers and discounts in relation to the DAZN Plans.
4.2. At the end of the free trial period and in the event that the DAZN Plan referred to in the preceding paragraph is not cancelled prior to such term, the user's chosen method of payment shall be debited with the monthly or annual amount thereof. To view the monthly and/or annual cost of the DAZN Plan and the expiry date of the free trial period, visit the website and click on the "My Account" page. If the DAZN Plan was subscribed to using your own account and indicating a third party as the method of payment, you may need to withdraw in accordance with Article 7.6.
4.3. DAZN reserves the right to provide free offers for selected content to users of the DAZN Service including, for example, Serie A and/or Serie B matches to be chosen at DAZN's discretion up to five Serie A matches per Championship and one Serie B match per day of the relevant Championship.
4.4. DAZN may make promotional offers relating to the DAZN Plan chosen by the user and concerning, by way of example but not limited to, the economic conditions of the offer or possible combinations with other content and/or third party services.
5. Economic aspects
5.1. Activation of the DAZN Services shall exclusively entail access thereto. Telephone line costs and any other communication or access costs will be charged separately to you by your ISP or electronic communications service provider. All our prices include taxes (VAT) at the rates in force from time to time.
5.2. The DAZN Plan may be either monthly with payment in advance of the full monthly amount at the time of activation or annual; in the latter case, depending on the methods offered by DAZN, the following payment methods may be envisaged
- annual with one-off payment in advance at the time of activation
- annual with payment deferred over 12 months to be paid in advance or offered as a promotion under specific conditions (DAZN Plans no longer available from 3 January 2024).
The user shall also be required to pay for any additional options subscribed to by the latter in accordance with the terms and conditions set out in the specific conditions applicable.
5.3. Payments must be made by credit card, debit card, PayPal, Google Pay, Apple Pay or other accepted, valid and current payment method, including third party providers of supported payment services ("Payment Method"). The user confirms that he/she is the owner of the Payment Method used, i.e. that he/she has the authorisation to use the same by the card or account holder. All accounts and Payment Methods are subject to authorisation and validity checks by the respective provider. If the Payment Method used is rejected, you will not be permitted to access the Content included in the DAZN Plan until a valid Payment Method is provided by you and approved by DAZN. For some Payment Methods the issuer may charge certain costs such as currency transaction fees or other fees related to the processing of the Payment Method. The tax charges applied vary depending on the Payment Method used. Please check with your Payment Method provider for details.
5.4. We reserve the right to reject payments in accordance with applicable law.
5.5. The amount due for the use of the DAZN Plan will be charged, depending on the payment method chosen by the user when subscribing to the DAZN Plan, either monthly or annually, on the calendar day corresponding to the date of activation of the service or as otherwise specified by the issuer of the Payment Method. In some cases the debit date may vary, for example if the activation day is not contained in a certain month. The payment will be processed through the use of a secure platform.
5.6. At the request of the user who has subscribed to a DAZN Plan, invoices will be sent to the e-mail address most recently held by us.
5.7. In the event of late payment by the user, DAZN reserves the right to suspend the service. This may only be reactivated following verification by DAZN that all outstanding amounts have been paid by the user.
5.8. You can view the next payment date and change your payment method by accessing the "My Account" section of the website. If you subscribe to the DAZN Plan using an account with a third party as the Payment Method, you may need to access that account to view payment information and change your chosen Payment Method.
5.9. Without prejudice to Article 2.3., DAZN reserves the right to change the price of the DAZN Plans. You will be notified of such price changes by email to the most recent address in our possession. These notices shall clearly state the increases in question and the sixty (60) day period from the notice within which you may withdraw from your contract without incurring any penalty or cancellation costs if you do not wish to accept the price changes envisaged to you which shall enter into force thirty (30) days after the notice or on the date to be indicated by DAZN and in any event not before the expiry of the aforementioned thirty (30) days. If the withdrawal is communicated by the client on a date subsequent to the 31st day and, therefore, in the event of a change in the economic conditions communicated, DAZN shall not refund the amount charged for the period between the 31st day and the effective date of withdrawal in accordance with Article 7.2. In the absence of such notice of withdrawal within the aforementioned period, the aforementioned changes shall be deemed to have been accepted.
5.10. For monthly DAZN Plans with certain Payment Methods, the user may be offered the option to pause the DAZN Plan for a limited period which will be, from time to time, indicated on the "My Account" page. The pause period shall commence from the first billing date following the request. If you decide to suspend the service, it will be reactivated automatically at the end of the period of suspension always indicated on the "My Account" page. Upon reactivation the user will be required to pay the amount due according to the DAZN Plan chosen on the same billing date which will remain unchanged.
If the user decides to reactivate the service before the end of the suspension period, the amount of the DAZN Plan chosen will be charged automatically on the day of reactivation which will become, from then on, the day of periodic billing.
5.11. In the event that "Klarna Pay in 3 installments" is among the available Payment Methods and is chosen by the user accepting its terms and conditions, the DAZN Plan’s contract will last for 12 months from the date of service activation with tacit renewal from year to year unless withdrawal with Klarna’s payment methodIf the user, before the expiration of the 12 months, upgrades its Payment Method by choosing an alternative payment option to "Klarna Pay in 3 installments", the contract shall be deemed tacitly renewed from year to year, unless terminated andthe renewal amount will be charged via the newly chosen Payment Method.
6. Contract conclusion method
6.1. In the event of a request for activation from the DAZN website or the DAZN App, the DAZN Services shall be activated following the indication of a valid and recurring Payment Method among those available at the time of subscribing to the offer, such as by way of example credit card, PayPal, Google Pay, Apple Pay and payment confirmation.
6.2. In the event of a request for DAZN Services through telephone contact, the contract shall be deemed to be concluded when the DAZN Services are activated after following the instructions given by the operator and following the indication of a valid and recurring Payment Method among those available when subscribing to the offer, such as for example credit card, PayPal, Google Pay, Apple Pay and payment confirmation.
7. Withdrawal by the User
7.1. The user may withdraw from the DAZN Plan by logging in to the DAZN platform in the "My Account" section and clicking on the option indicated for that purpose or by contacting DAZN customer service at the contact details described in article 15. and communicated by DAZN, for example, on its website. The request to withdraw from the DAZN Plan may be made at any time prior to its expiry according to the procedures described below.
7.2. The withdrawal from the monthly DAZN Plan must be made with a notice of thirty days prior to the date of the next billing of the DAZN service available by accessing the section of the DAZN site "My Account". Therefore, on the date of the next scheduled invoice to the user, the latter shall be charged the fee corresponding to the eventual days of notice lacking with respect to the aforementioned thirty days. The user shall use the DAZN Service until the end of the notice period.
7.3. For the annual DAZN Plan with lump sum payment, the withdrawal shall be effective from the date of natural expiry of the contract. From the date of notice of withdrawal until the aforementioned expiry date, the customer may continue to use the service, it being understood that DAZN will not have to return the amount charged for the remaining period.
7.4. For the annual DAZN Plan with payment deferred in 12 monthly instalments, the withdrawal will be effective from the date of natural expiry of the contract. From the date of notice of withdrawal until the aforementioned expiry date, the customer may continue to use the service and will be required to pay the remaining monthly amounts until the natural expiry date of the contract.
7.5. For the annual DAZN Plan with payment in instalments offered as a promotion (which can be subscribed to until 3 January 2024), the conditions set out in the following link will apply to the withdrawal: Tariff transparency offers 2024.
7.6. In the event that the user has subscribed to the DAZN Plan through third party partners (e.g. Apple, Tim) and wishes to withdraw from the same, he/she shall proceed according to the instructions of the third party partner from which he/she purchased in accordance with the conditions provided by this third party, thereby simultaneously withdrawing from the DAZN Plan through this third party.
8. Exclusion of the Right of Withdrawal
8.1. DAZN offers Content which by its nature allows the user the immediate activation of the service and the associated DAZN Plan. In this regard, unless otherwise provided, DAZN avails itself of the regime of exception provided for in Article 59, paragraph 1, Legislative Decree no. 206/05 ("Consumer Code") concerning the exclusion of the right of withdrawal for contracts for the provision of services whose execution has begun with the express agreement of the user and with the acceptance by the latter to proceed with the activation and commencement of the service, thus waiving the right to withdraw in the first 14 days from the signing of the contract.
9. Technical Requirements
9.1. It is your responsibility to ensure the possession and maintenance of the hardware and software required to access, receive and view the DAZN Services.
9.2. We will use our best endeavours to ensure that DAZN Services are always available. However, the DAZN Services are provided on current terms, without any further warranties, so without prejudice to Articles 9.4 and 14 below, we shall not be liable to you as a result of, for example, the cancellation or interruption of an event, or the failure to broadcast a scheduled or advertised event, or the inability of you to view an event on a specific device on the platform for reasons not attributable to DAZN.
9.3. From time to time we may need to suspend DAZN Services in order to carry out maintenance or updates which, in any event, will be communicated to customers in advance or carried out at times that do not affect the enjoyment of the service. We will endeavour to limit such suspensions as much as possible. We undertake to provide the DAZN Services with reasonable care and professionalism. Other than this we make no representations or warranties and, subject to Section 14, exclude any further warranties. This is without prejudice to any other rights you may have as a consumer under applicable law. DAZN, and not any third party payment service provider, shall be the addressee of any claim that you or any third party may have in relation to the DAZN Services and/or your use thereof.
9.4. If you believe you are entitled to a refund, you must follow the procedure set out in the DAZN Service Charter available on the DAZN website or contact us by selecting the "Contact us" option on the DAZN website or from the DAZN App. If the user has purchased the DAZN service from third party partners (by way of example, Apple, Tim), the user shall follow the reimbursement procedure indicated by the third party partner used for the purchase.
9.5. The quality of sports streaming may vary from device to device, and may be affected by a variety of factors, such as your location, available bandwidth and/or internet connection speed.
9.6. The minimum download speed recommended in this regard depends on the type of device being used, as illustrated at: https://www.dazn.com/help/articles/how-fast-does-my-internet-need-to-be-it
We recommend that you check with your Internet service provider about possible costs for using Internet data.
9.7. The streaming software used to deliver the DAZN Services may vary from device to device and medium to medium, and the functionality may also vary from device to device. You understand that use of the DAZN Services may require third party software subject to relevant licences.
10. Use of the DAZN Services
10.1. We are the owner or the licensee of all intellectual property rights related to the DAZN Services (including all Content). All material, including without limitation the design, text, software, graphics, images and footage received from you (and selections or reworkings thereof) are subject to our and/or others' copyright. In the event of any claim by any third party that the DAZN Services or your use of the DAZN Services infringes the above intellectual property rights of any third party, we (and not a third party payment service provider) shall be solely responsible for investigating, defending, settling and resolving such claim.
You agree to:
10.1.1. use the DAZN Services exclusively for non-commercial purposes, without gaining any gain, financial or otherwise, and not to allow other persons to use the DAZN Services, with the exception of members living in your household. You shall not request payment for the viewing of DAZN Services, nor shall you use DAZN Services to entice other persons to purchase products, either from yourself or from third parties, or to access certain premises;
10.1.2. view DAZN Services only through authorised devices in accordance with Article 10.3 below. The password must be kept secure and together with the other access codes must not be shared with anyone or otherwise made accessible to others. You acknowledge that the sharing of passwords and/or other access codes carried out in order to allow third parties to access DAZN Services, in violation of the relevant Terms of Use, constitutes an illegal and fraudulent activity in relation to which DAZN reserves the right to take any action for your protection, including compensation for damages;
10.1.3. not copy, record or store all or any part of the DAZN Services (except to the extent permitted by us as part of the functionality of the application), or hijack, re-share, re-transmit, stream or otherwise distribute all or any part of the DAZN Services to others, or authorise, permit or cause others to do any of the foregoing
10.1.4. not alter, disassemble, decompile or reverse engineer any part of the DAZN Services
10.1.5. not view DAZN Services in circumstances where the public may simultaneously view it or authorise, permit or cause any other person to do any of the foregoing
10.1.6. not abuse DAZN Services or use them for illegal or unauthorised purposes (including, for example, transmitting computer viruses through the site, or using the site in a manner that infringes the rights of others).
10.2. We may suspend or block access to the DAZN Services with immediate effect, or cancel any promotions, offers or discounts related to access, if
10.2.1. there are reasonable grounds for believing that:
10.2.1.1. your use of the DAZN Services is offensive or against the interests of other users;
10.2.1.2. the user has violated these Terms;
10.2.1.3. it is required by an Authority.
You will be informed in advance of any such termination, suspension or cessation of DAZN Services. However, such notice may not always be possible.
10.3. The user, except as otherwise provided for by any additional specific offers, has the right to simultaneously use up to a maximum of two devices associated with his account if connected to his home internet network (cable or wi-fi: fibre, xDSL; FWA) to benefit from DAZN Services; in all other cases, the user may benefit from DAZN Services on a single device. DAZN reserves the right, subject to notice to the user, to insert, for each month of the contractual term, a maximum number of times in which the user may change the devices associated with his account with other devices. Pursuant to Article 10.1.2 above, the user agrees that the login data is unique to the same and cannot be shared with others; the user acknowledges that any violation of this provision constitutes an illegal activity in relation to which DAZN reserves all actions for its protection, including compensation for damages. Such data may be modified at any time by visiting the DAZN website and clicking on the "My Account" section.
11. Protection of user security
11.1. It is important that you always access your account information by directly accessing DAZN Services and not through a hyperlink contained in an email or other electronic communication from a third party even if apparently from DAZN.
11.2. In particular, you should beware of communications requesting you to provide credit card, account and/or personal information; this type of request could lead to identity theft.
12. Age Limits
12.1. To use the DAZN Services you must be 18 years of age or older, which is the age of majority in the country where you reside.
13. Compensation
13.1. You agree to fully indemnify us in relation to any damages, expenses and costs (including legal fees) incurred by us as a result of:
13.1.1. misrepresentations, wilful or negligent acts or omissions made by you in connection with your use of the DAZN Services;
13.1.2. wilful or negligent breach by you of one or more provisions of these Terms;
13.1.3. actions brought by third parties as a result of or in connection with your wilful or negligent access to the DAZN Services in a manner inconsistent with these Terms.
13.2. The damages referred to in Clause 13.1. also include any liability incurred to our related parties or our licensors (or the licensors of our affiliates) (including affiliates of our affiliates) as a result of any of the events referred to in Clauses 13.1.1.
14. Liability
14.1. The DAZN Services are provided as they are. We (including Our sports event licensors) shall not be liable to You or to any third party in the event of any (full or partial) delay, malfunction, suspension, interruption and/or unavailability (each of these individually referred to as an "Unavailability") in the provision of the DAZN Services caused by: force majeure or unforeseeable circumstances; tampering with or unlawful intervention by third parties on services and equipment used by Us; tampering with or intervention on equipment within the availability of the user; incorrect use of DAZN Services by the user; malfunction/incorrect configuration of equipment used by the user; or by unavailability, insufficient bandwidth, or lack of adequate speed of the access service (such as the user's bandwidth provision service or internet connection).
Furthermore, we shall not be liable for any damages resulting from your failure to comply with your obligations under these Terms.
14.2. Where the DAZN Services contain links to sites and resources provided by third parties, we have no control over the content of those sites, resources or services. Your use of such third party sites, resources or services will be covered by the terms and conditions and privacy policy of that third party, and we disclaim any liability in relation to the same or in relation to any loss or damage that may arise from your use of them.
14.3. Comments and other materials posted on the DAZN Services are not intended to provide advice on which reliance should be placed. We therefore disclaim any liability as a result of reliance placed on such materials by users of the DAZN Service or anyone who may be informed of such content.
15. Contact
15.1. You may contact us for the resolution of technical problems, to lodge a complaint or for any other reason by calling 0282958308, by writing to an operator in chat on our DAZN website or in the DAZN application or by sending an email to help@dazn.com. You can also request information by consulting the "Help" section of the DAZN website or the DAZN application or via our whatsapp channel. The user may at any time consult the list of DAZN assistance channels as well as the relevant assistance times on the DAZN site. In order to assist you, we may require you to provide email, residential address, product details, payment information, and among these the address to provide support or identify the DAZN Plans you have subscribed to. It will be our responsibility (and not that of the third party payment service provider) to provide all necessary maintenance and support in relation to the DAZN Services. Dazn will match the complaint with an identification code to improve traceability. Dazn will acknowledge complaints within 30 days of their receipt.
15.2. You are required to notify us immediately of any changes to your personal data by updating it in the "My Account" section of the website or via the app Any communication from us will be sent by email to the most recent address in our possession. We will not be responsible for not receiving messages sent to you.
16. Third Party Applications
16.1. You may use third party applications (including, without limitation, websites, widgets, software, or other software utilities) ("Applications") that interact with the DAZN Services. Your use of such Applications may be subject to the third party's terms of use or licence, with which you shall comply. We shall in no way be liable in connection with the terms of any third party Applications that you may use as part of the DAZN Services.
17. Force Majeure
17.1. Neither we nor any third party rights holder shall be liable for any delay or failure to provide DAZN Services to the extent that such failure or delay is due to causes beyond our or such third party's reasonable control, including, without limitation, failure of mechanical or electronic equipment or communication lines, actions of third parties (e.g. blocking of service and abuse or misuse of the DAZN Services), telephone or other connection problems, computer viruses, unauthorised access, theft, Internet Service Provider errors, fire, adverse weather conditions including floods, acts of God, pandemics, war, riots, actions or regulations of governmental or supranational authorities and the cancellation or postponement of events.
18. Waiver
18.1. No forbearance by DAZN or any third party rights holder of any breach by you shall be construed as a waiver of your rights or remedies at law or as a forbearance of further breach of any provision or provisions of these Terms by you.
19. Assignment
19.1. Notwithstanding the next paragraph of this Section, we may assign, subcontract or otherwise dispose of our rights and/or obligations under these Terms without notifying you or obtaining your consent.
19.2. Notice will be given to you in the event of an assignment to a third party.
20. Severability
20.1. Should any provision of these Conditions be unlawful or unenforceable in whole or in part, this shall not affect the validity of the remaining Conditions.
21. Special Conditions applied to certain DAZN Plans
21.1 DAZN Family Plan (already Plus until dd/mm/yy)
For the DAZN Family Plan, Article 10.3 above is replaced by the following: "The user, except as otherwise provided by any additional specific offers, shall have the right to simultaneously use up to a maximum of two devices associated with his account even if not connected to the same home internet network (cable or wi-fi: fiber, xDSL; FWA) to enjoy DAZN Services; in all other cases, the user may enjoy DAZN Services on a single device. DAZN reserves the right, subject to notice to the user, to insert, for each month of the contractual term, a maximum number of times in which the user may change the devices associated with his account with other devices. Pursuant to Article 10.1.2 above, the user agrees that the login data is unique to the same and cannot be shared with others; the user acknowledges that any violation of this provision constitutes an illegal activity in relation to which DAZN reserves all actions for its protection, including compensation for damages. Such data may be modified at any time by visiting the DAZN website and clicking on the "My Account" section.
21.2 DAZN "My Club Pass" plan
The user will be able to view the Contents included in the "MyClubPass" Plan on the websitewww.dazn.com/it ("Dazn website").
The MyClub Pass Plan entitles the user to enjoy all matches of the Lega Serie A Football Championship relating to a single Serie A Club chosen by the user when signing the Plan. It will not be possible for the user to change the Club chosen during the contract.
At any time, the user may switch from MyClub Pass to a higher DAZN Plan (Full Plan or Family Plan) by accessing the "My Account" area on the DAZN.com website or through the DAZN App, following the instructions provided.
In the event of relegation to Serie B of the Club chosen by the user, the latter shall continue to have access to the viewing of the matches played by his Club in addition to the other matches of the Serie B Football Championship until the end of the term of his contract relating to his "My Club Pass" Plan which in the latter case, notwithstanding the provisions of article 3.1, shall not be tacitly renewed.
If for any reason whatsoever and/or as a result of sanctions of any nature (by way of example and not limited to cases of bankruptcy of the Club or disqualification or sanction by the competent Leagues or Federations or Courts) the Club selected by the user is relegated to a Championship lower than Serie B and/or if it is suspended and/or disqualified from competing in the Italian Championships, the contract shall be deemed to be terminated by right and the user shall be refunded the portion of the amount already paid by the same to DAZN corresponding to the residual period not enjoyed.
22. Applicable Law and Jurisdiction
22.1. These Conditions shall be governed by Italian law, including consumer protection laws.
22.2. For any dispute relating to the DAZN Services and/or to these Terms, the Italian jurisdiction shall be the consumer's court, subject to prior recourse to the applicable out-of-court dispute resolution procedures such as those provided by the Authority for Guarantees in Communications with Resolution no. 194/24/CONS regarding the possibility for the user to initiate a free simplified conciliation through the platform of the Authority for Guarantees in Communications called "Conciliaweb" at www.conciliaweb.agcom.it.

23. Special terms and conditions for Dazn Services accessible via third-party platforms
23.1. In cases where, by virtue of specific agreements, the DAZN Services are made available to the user through third party partner platforms, the user must, in order to be able to access such DAZN Services
- have concluded with the third party partner the contract relating to the use of the service/product/platform of the latter and have accepted the relative contractual and commercial conditions, and
- create a DAZN account or, where possible, migrate a previous account in the manner indicated by the third party partner
23.2. The use of the Dazn Services made available through third-party partner platforms shall be governed by these Terms of Use of the Dazn Services and Plans which shall apply with the exception of the following articles: article 3. "Duration"; article 5.2. first sentence, 5.5., 5.6. and 5.9. "Economic aspects"; article 6.2. "Method of conclusion of the contract"; article 8. "Exclusion of the Right of Revocation".
24. Special Conditions for "Pay per view" events
24.1. To users who have subscribed to a DAZN Tariff Plan that is not free of charge DAZN may make available the purchase on an event-by-event basis of additional individual content (so-called "pay per view events" or "events/events"). The provision of such events shall be governed by these terms and conditions, which shall be deemed to be supplemented by this article.
24.2. The fee for the purchase of the additional event will be indicated in the purchase flow and will be charged immediately to the Payment Method chosen by the user at the time of purchase. The user acknowledges and accepts that the event may be subject to cancellation for reasons not attributable to Dazn.
