Effective from 6th December 2024 to 31st December 2024.
1. WHO WE ARE
We are a subscription service offering subscribers streaming access to a wide range of sporting events from around the world on a variety of internet-enabled devices, including TVs, PCs and other platforms (‘DAZN Service’). To enhance your enjoyment of the DAZN Service you will also be provided with suggestions of events in which you may be interested and other interesting sports information.
The DAZN Service is provided by DAZN Limited (‘DAZN’).
2. PREPAID CARDS AND PREPAID CODES
1. Prepaid cards (‘Cards’ or, individually, ‘Card’) and prepaid codes (‘Codes’ or, individually, ‘Code’) are issued by DAZN and are purchasable at authorised third party points of sale or in other ways communicated for this purpose. The prepaid ‘Christmas Card’ (“Christmas Card” or “Card”) can only be purchased at selected Unieuro points of sale in Italy during their opening hours and only during the promotional period intervening from 6th to 31st December 2024.
2. The DAZN Standard prepaid Christmas Card is a limited edition card that can be activated in Italy within 3 months from the date of purchase only, using the code printed on the receipt issued at the time of purchase, can used only once and allows subject to the provisions of paragraph 3 below, the use of the Standard DAZN Service at the economic conditions and for the duration provided for the purchased Card. After the end of 3 months from the date of purchase, the prepaid Christmas Card will expire and will no longer be activated.
The price of € 179.96 is calculated considering the current list price of the DAZN Standard monthly plan of € 44.99 multiplied by 4 months. The maximum saving of €165 is calculated including the value of the month offered by DAZN (fifth), which can be obtained by activating the 4-month prepaid code no later than 31 December 2024.
The additional month (fifth) offered by DAZN is only obtainable by activating the 4-month prepaid code no later than 31 December 2024 and will be delivered by email (also in the form of a prepaid code) by 15 January 2025.
In order to use ‘Christmas Card’ prepaid card , the purchaser (‘User’) must
a) create a new DAZN account - if he/she is of age and subject to acceptance of the terms and conditions of use of the DAZN service (‘Terms of Use’) as well as having previously viewed and accepted the privacy policy at www.dazn.com - or already have an account with direct payment to DAZN.
b) have a device enabled to use the DAZN Service and an internet connectivity service, in accordance with the minimum connection requirements and enabled devices indicated on www.dazn.com or in the Conditions of Use.
4. Cards and/or Codes are non-refundable and can only be used within the Italian national territory.
TERMINATION AND RENEWAL
3.1. Following the activation of the Card and/or a prepaid ‘Christmas Card’ Code, the use of the DAZN Service - with maintenance of the relative account - will be guaranteed to the User until the scheduled expiry of the Card itself or the same Code, subject to the provisions of article 3.2 letter b) below.
3.2. If at the time of activation or during the period of validity of the prepaid ‘Christmas Card’, in the manner provided for in art. 3 above
a) the User did not enter a payment method among those proposed, the use of the DAZN Service will terminate at the end of the period of validity provided for the same prepaid Card; and/or the same Code;
b) The User has inserted a method of payment among those proposed, the use of the DAZN Service chosen will be renewed at the ordinary cost (monthly or annual) of the same DAZN Service, which will be charged automatically upon expiry of the Card prepaid ‘ Christmas Card’ and subsequently according to the terms of use and the economic conditions in force at that time of the renewal of said service in force, including the payment methods time to time provided for and specified by DAZN for the chosen Service, using the payment details provided by the User. The User may at any time request the deactivation of such automatic renewal, in accordance with the contractual conditions set out in the chosen DAZN Service and in the Service Charter, by one of the following means:
1. By logging in to the ‘My Account’ page and clicking on the ‘cancel subscription’ button;
2. By contacting Customer Service
3. By sending a clear communication to this effect by Pec to dazncs@legalmail.it.
4. LOSS, DESTRUCTION OR ILLEGIBILITY OF CODES
4.1. The risk of accidental loss, destruction or illegibility of the Card and/or Code is transferred to the User at the time of purchase. The User remains solely responsible for the safekeeping and use of the Card and/or Code and for any proper and/or improper use that may be made of them.
4.2. DAZN shall not be liable in the event of theft, loss or unauthorised use of the Card or Code.
5. PERMITTED USE
The Card and/or the Code may only be used for lawful purposes. The User therefore undertakes not to use them in any way that violates any applicable local, national or international law or regulation and/or in any way that is illegal or fraudulent or has an illegal or fraudulent purpose or effect. The card and/or code may not be transferred for monetary and/or other consideration.
6. VARIATION
Any changes to these Conditions will be notified to you by email to the most recent address held by DAZN. Any changes to the payment terms will also be notified to the User in the same manner. Such notice will clearly state the changes in question and the reason for them as well as the term of sixty (60) days from the notice within which the User may withdraw from his contract if he does not wish to accept the contractual changes proposed to him. In the absence of such notice of withdrawal within the aforementioned period, the contractual changes shall be deemed accepted. Notwithstanding the foregoing, changes made in order to comply with the law, including in the case of changes in legislation, may have immediate effect.
7. JURISDICTION AND APPLICABLE LAW
7.1. These Conditions are governed by Italian law, including consumer protection laws. The Italian version prevails in case of conflict with the English translation.
7.2. For any dispute relating to these Conditions, the Court of Milan shall have exclusive jurisdiction, with the exception of disputes with consumers for which, pursuant to Article 66-bis of the Consumer Code, the Court of the place of residence or domicile of the consumer shall have jurisdiction.
