General terms and conditions of DAZN for the sale or supply of the SET TOP BOX, valid until October 2nd, 2024
1. Subject matter
The following General Terms and Conditions of Sale ("Terms") govern the terms and conditions by which DAZN Limited, having its registered office at 12 Hammersmith Grove, W6 7AP, London, United Kingdom, registration number with the Registrar of Company for England and Wales 09676399, P. VAT GB945612024 (hereinafter referred to as "DAZN"), provides to its Customers (as defined below), through Digiquest Solutions srl, or through other channels pertaining to DAZN, the product called "Set Top Box" (hereinafter referred to as "Product").
"Customer" means the natural person who intends to purchase or receive the Product for purposes other than the entrepreneurial and professional activity carried out, if any.
The Conditions are established solely by DAZN without any interference from Digiquest Solutions surl, which is in charge of the sale on behalf of DAZN.
2. Method of Purchase.
The Customer may order the Product at https://dazn.digiquest.it/ on the terms agreed from time to time.
All Product orders are subject to the availability of the same.
The picture accompanying the descriptive sheet of the Product may not be perfectly representative of its characteristics, but differ in colour, size, accessory elements present in the picture.
In the case of ordering on the site https://dazn.digiquest.it/, the Customer must fill out a form in which he must enter his data, with full address (including street-number and province), and accept the conditions of sale and privacy policy.
Attention: On the site https://dazn.digiquest.it/, it is possible to make only one purchase based on the tax code entered in the check-out form.
3. Prices and Methods of Payment
In the case of supply against payment on https://dazn.digiquest.it/, the Customer shall pay to DAZN, as the price for the purchase of the Product, the amount agreed in the order phase and summarized in the order confirmation.
The price shall be paid according to the terms and conditions agreed in the order and summarized in the order confirmation.
The list price of the Product is subject to change without notice.
The price agreed with the Customer at the time of order shall remain valid until the order is fully executed.
All prices are inclusive of VAT.
Shipping costs will be indicated in the order phase and stated in the order confirmation.
The costs of electricity supply and internet connection that allow the use of the Product, once purchased, are the sole responsibility of the Customer, according to the terms established by its supplier.
4. Order Status and Delivery
In case of purchase of the Product on the website https://dazn.digiquest.it/, the same will be delivered to the Customer at the address, at the time and in the manner agreed upon in the order and summarized in the order confirmation.
Ownership and risks related to the Products will pass to the Customer from the moment of their delivery.
The Customer will be able to monitor the shipment, details and status of the order in the reserved area automatically created on the Digiquest platform once the purchase of the Product has been finalized.
5. Right of withdrawal
In the case of purchase of the Product by the Customer on the site https://dazn.digiquest.it/, the latter may return it and receive a refund of the price paid without penalty and without specifying the reason, within 14 days of its receipt, provided that they are complete and undamaged at the address that can be consulted in the FAQ of the DAZN site dedicated to the Requirements of the Internet connection. Shipping costs for the return are the responsibility of the Customer.
The refund of the price will be credited by DAZN to the Client in 14 days from the receipt of the returned Product, using the same payment methods used by the Client for the purchase, unless otherwise indicated by the Client to DAZN Customer Service [https://www.dazn.com/help]
In the case of free supply of the Product, where the same is not used, the Customer shall not be entitled to refunds and may properly dispose of the Product following the instructions provided by its municipality of residence as there is no right of return; in the case of malfunction, the customer may request replacement with a new Product.
6. Warranty
The Products are covered by the legal warranty on consumer goods, governed by articles 128 et seq. of the Consumer Code, which covers conformity defects and/or malfunctions that occur within 2 (two) years from the date of delivery of the goods to the Customer.
The legal guarantee of conformity does not cover defects in the Product resulting from normal wear and tear, abnormal or improper use, accidental events (e.g. fall) or otherwise maliciously caused to the Product itself, nor does it cover defects resulting from repairs carried out in the manner or by centers not authorized by DAZN.
To receive warranty assistance on the Products, Customer may contact DAZN Customer Service through the "chat with us" option via the support pages or by clicking here. The Customer loses the right to the warranty if he/she does not report the conformity defect within the term of 2 (two) months from the date he/she discovered it.
The warranty will be provided by DAZN through the taking in charge of the Product, upon delivery of the same by the Customer to the service center indicated by DAZN's Customer Service [https://www.dazn.com/help] or upon collection of the Product by DAZN (also through third parties appointed by it). In any case, the Client must be provided with a receipt proving the purchase made. DAZN will subject the Products to a technical examination and if a conformity defect covered by the legal warranty is ascertained, the Customer may request, at its option, DAZN to repair the good or to replace it, without charge in either case, unless the remedy requested is objectively impossible or excessively burdensome compared to the other.
In the case of replacement, the replacement Product will be delivered within a reasonable time, consistent with the availability of the Product, upon return of the nonconforming Product.
The other rights provided for in Chapter I, Title III, Part IV of Legislative Decree n.206/05 (Consumer Code) shall remain unaffected.
7. Application Software.
DAZN warrants that it has the right to use the application programs and software necessary for the operation of the Product and to grant their use to the Customer within the scope of the Agreement.
The Customer undertakes to use the application programs and software, solely and exclusively for the operation of the Product, not to allow their access and use to third parties, as well as not to carry out any copying, decompilation or modification of such programs or other similar activities that are in violation of the copyright protection of the same.
8. Termination
In case of non-payment of the price by the Customer within the terms agreed in the purchase order, DAZN may terminate by right the sales contract pursuant to and in accordance with Article 1456 of the Italian Civil Code.
9. Force Majeure
DAZN shall in no way be liable for failures or delays in the performance of any of its obligations under the Agreement caused by unforeseen and unforeseeable events beyond its reasonable control ("Force Majeure Events").
Events of Force Majeure include but are not limited to the following: strikes, lockouts, or other labor unrest; terrorist attacks or threats of terrorist attacks; wars (declared and undeclared), or threats of war; fires, explosions, storms, floods, earthquakes, landslides, epidemics, or other natural disasters; inability to use railroads, shipping by sea, air, motor transportation, or other means of public or private transportation; inability to use public or private telecommunications networks; acts, decrees, laws, regulations, or restrictions of any government.
Performance of obligations under the contract will remain suspended for the duration of the Force Majeure Events.
10. Right to change these Terms.
DAZN reserves the right to modify these Conditions at any time, without prejudice to the effects of agreements already concluded. Therefore, the relationship with the Customer will be governed by the General Terms and Conditions in effect at the time of the order, unless a change must be made pursuant to law or at the request of a governmental authority (in which case it will also apply to orders already transmitted).
11. Applicable Law and Jurisdiction.
These Conditions are governed by Italian law.
For any dispute the Judge of the Customer's place of residence or domicile shall have jurisdiction.
