Introduction and Definitions

1. DAZN Limited ("DAZN", "we", "our") may from time to time make available features that let account holders ("Users", "you") create, augment, post or share content ("User Content"), interact with programming or other elements of the DAZN Service, or interact with User Content from other users on the DAZN Service (together, "Interactive Features").
2. These Interactive Features Terms of Use (“Interactive Features Terms”) are supplementary to the DAZN Terms and Conditions and govern your use of any Interactive Features. In the event of any conflict, the DAZN Terms and Conditions shall prevail.
3. It is your responsibility to comply with these Interactive Features Terms in addition to respecting all applicable local, national and international laws while using the Interactive Features and any part of the DAZN Service.

Eligibility and Access

4. By using the Interactive Features you confirm that you meet the age requirements set out in the DAZN Terms and Conditions.
5. Your DAZN account is personal to you and you are responsible for anything done through it. The Interactive Features are free to use, ancillary to the DAZN Service and do not form part of your current subscription to the DAZN Service. Consequently, we reserve the right to remove, suspend or modify the Interactive Features.

Identity and Public Profiles

6. All of the information you choose to provide to create your profile on DAZN, such as display name, avatar or favourite team may be accessed by other Users. Your profile may also show additional information about your use of DAZN such as status updates and your participation in public community forums. We will not display your email address, exact location, payment history, subscription details or other personal information.
7. To protect your privacy, we encourage you to use a pseudonym as your display name. You must not upload any personally identifiable information of you or from any other person or User when using an Interactive Feature. This includes, but is not limited to, your real name, address, email address, bank details or any other information that could enable another User to identify you.
8. You must not impersonate anyone else, claim an identity you do not hold, or use names, images or brands you do not have the right to use.
9. We may reclaim or change a display name that infringes the rights of others, is misleading, or breaches these Interactive Features Terms or the DAZN Terms and Conditions.

Prohibited Conduct

10. When engaging with Interactive Features, you must not:

    10.1 use the Interactive Features in an unlawful manner, for any illegal or unlawful purpose, or in any manner inconsistent with these Interactive Features Terms, the Community Guidelines or the applicable DAZN Service Terms and Conditions;

    10.2 engage in any of the following:

    10.2.1 phishing or defrauding others, spreading malware, viruses or inappropriate or malicious content;

    10.2.2 spreading misinformation (such as feigning distress, posting misleading metadata, or intentional content misrepresentation);

    10.2.3 selling or sharing user accounts, or attempting to gain unauthorised access to, circumvent, interfere with, damage or disrupt any parts of the DAZN Service or any server, computer or database connected to the DAZN Service;

    10.2.4 monitoring or copying any material on the DAZN Service, including data mining, data harvesting, data extracting, or any other similar activity;

    10.2.5 promoting terrorism or sharing terrorist content;

    10.2.6 be obscene, abusive, sexist, offensive or racist, or promote or propose hatred or physical harm against anyone;

    10.2.7 share content that may reveal personal information about you or another User or their private property;

    10.2.8 stream, restream, broadcast, transmit or otherwise enable onwards distribution of any DAZN content or any other third party content that you do not have the necessary rights to distribute;

    10.2.9 sharing content that amounts to repetitive and unwanted messages, or spam;

    10.2.10 sharing confidential information of third parties;

    10.2.11 posting, sharing or directing others to unauthorised streams, pirated content, piracy devices or services, or instructions designed to facilitate access to them;

    10.2.12 undermining sporting integrity, including match‑fixing or manipulation, trading in inside information, or sharing or requesting real‑time data obtained by prohibited means;

    10.2.13 posting betting tips, odds or other gambling advice, or coordinating or promoting ticket touting or resale;

    10.2.14 using the Interactive Features for commercial purposes, including advertising, promotions, affiliate codes, sponsorships, endorsements or other self‑promotion, without our prior written approval;

    10.2.15 posting any external third‑party links in posts or chats, or use obfuscated or indirect methods to direct users off the DAZN Service, including link shorteners, spacing or bracketing a URL, or writing instructions that guide users to off‑platform destinations (this does not restrict DAZN’s own platform share features, which we may provide from time to time).

User Content and Liability

11. Your use of Interactive Features, and any User Content that you create, post or share on the DAZN Service, must comply with our Community Guidelines.
12. You warrant that you own or have the rights you need to post any User Content and that User Content does not infringe the rights of anyone else.
13. You grant DAZN a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish and distribute your User Content solely for the purposes of operating, promoting and improving the DAZN Service and DAZN’s related products and services. This licence continues for as long as your User Content remains on the DAZN Service and for a reasonable period thereafter to allow for technical removal.
14. The licence granted above includes the right to sublicense to DAZN’s affiliates, service providers and partners solely to the extent necessary to operate and provide the DAZN Service.
15. To the extent permitted by applicable law, you agree not to asset any moral rights or similar rights you may have in your User Content against DAZN’s reasonable exercise of the licence granted above. You consent to DAZN using your display name, avatar and publicly available profile information in connection with your User Content and DAZN's services and marketing.
16. To enable your continued participation, we grant you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use your own User Content in the ordinary operation of the DAZN Service.
17. You do not acquire any rights in DAZN’s content or in other users' User Content, and you must not copy, download, distribute, modify or reuse such content without permission.
18. We do not guarantee any type of confidentiality in relation to any User Content shared by any User. You will be solely responsible for your own User Content and the consequences of engaging with other Users’ User Content.
19. We do not endorse or sanction any content, opinion, recommendation or advice shared on the DAZN Service. Although we use a combination of automated systems and human review to help keep the Interactive Features safe, our liability for User Content or your use of the Interactive Features is limited to the extent permitted by law. This limitation does not apply to our intentional acts or gross negligence, personal injury or death, or any other liability that cannot be excluded or limited under applicable law.
20. To the extent you are at fault you will fully compensate us for reasonable losses we suffer as a result of your intentional or negligent breach of these Interactive Features Terms, or a claim by someone else that your User Content infringes their rights or was posted unlawfully, or in breach of these Interactive Features Terms. This does not apply to losses caused by circumstances beyond your control or by DAZN’s own actions.

Moderation and Enforcement

21. We reserve the right to remove content identified as contrary to these Interactive Features Terms or temporarily restrict or suspend or remove your ability to use Interactive Features for any conduct that we determine to be contrary to these Interactive Features Terms or applicable law. Where we take action against you, we will do so proportionately to the severity of the conduct and, in accordance with the applicable law, if possible, we will notify you in the event we remove your User Content or take any other enforcement action against you. Any attempt to circumvent a suspension by using other accounts may result in a further suspension or termination.
22. We may assess risks related to illegal content and implement measures to reduce the presence and dissemination of User Content that is illegal, inappropriate or contrary to these Interactive Features Terms, including removing such content when we are alerted to its presence or communicating such illegal or inappropriate content to the applicable authorities.
23. If you have a complaint about a content decision or behaviour on the DAZN Service, please contact us via the Help Centre. Further details of complaints routes will be provided in the Help Centre. For users in the EU, out‑of‑court dispute settlement options may be available under the applicable legislation once designated bodies are in place.

Reporting Concerns

24. If you consider that there is any abusive or unacceptable behaviour on the DAZN Service, please report it using our Help Centre webform or the in-service reporting tools, where available.

25. Should we receive a report of any abusive or unacceptable behaviour or become aware of any such behaviour, we reserve the right to:

    25.1 remove the relevant User Content from the DAZN Service;

    25.2 remove, suspend or mute a User; and/or

    25.3 block and unblock any User.

26. We may immediately restrict access or close an Interactive Feature to a User or group of Users if we have reasonable grounds to believe a User or Users are in breach of these Interactive Features Terms or the DAZN Terms and Conditions and in order to protect the safety or functioning of the DAZN Service.

Privacy

27. Any personal information that you provide to us will be processed in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use, retain and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
28. We retain User Content and related moderation records for as long as necessary for the purposes for which they were collected, including to operate and improve our services, to enforce our terms, to comply with law and to protect DAZN and other users, and as otherwise set out in our Privacy Policy.

Digital Services Act (EU Users)

The following applies where the Digital Services Act (EU) applies to your use of the DAZN Service:

29. We use a combination automated systems and human review to moderate the content made available on the DAZN Service, and provide a mechanism for a User to notify us of allegedly illegal content. Further information on our moderation and notification mechanisms are made available in the Help Centre.
30. Where required, we will provide a statement of reasons when we restrict or remove content or suspend or terminate a User, which we may deliver in-product or by email.
31. We operate an internal complaints-handling system for users in the EU to challenge our content moderation decisions. You may submit a complaint within six (6) months of receiving a statement of reasons by contacting us via the Help Centre. We will process complaints in a timely, non-discriminatory, diligent and non-arbitrary manner and will inform you of the outcome without undue delay.  Details, including channels and any indicative timeframes, will be provided in the Help Centre.

Changes, governing law and statutory rights

32. These Interactive Features Terms shall be exclusively governed by and construed in accordance with the laws of Spain.
33. Nothing in these Interactive Features Terms affects your statutory rights as a consumer.
34. We do not, subject always to the contract dictated by applicable law, participate in dispute resolution proceedings before a consumer arbitration board. We prefer to solve your requests directly with you. For this purpose, please do not hesitate to contact us by visiting the “Contact Us” section of our website or app. Please note that pursuant to statutory provisions of consumer law, you will be entitled to bring actions before the Courts of the place of your domicile.
